Terms and conditions for Squat deluxe Berlin GmbH/ bicycles

1 language
The language available for the conclusion of the contract is English or German.

2 Prices
All prices are in euros and including German VAT.

3 Availability
The offers on the Internet are valid as long as they are presented on the Internet. Any delivery times for articles are explicitly pointed out.

4 Payment methods
Cash in the Store, Paypal , bank transfer or any other agreed electronic way to transfer money is possible.
We reserve the right to deliver the goods only after the full payment is received.

5 Retention of title
The goods remain the property of Squat deluxe Berlin GMBH until they have been paid for in full.

6 Deliveries and shipping charges
Our delivery conditions apply to shipping to a shipping address within the Federal Republic of Germany.
A self collection of the product is also possible.

7 Guarantee
A- 2nd hand bicycles: There is no warranty for 2nd hand bicycles.
B- New bicycles:
. Delivered bicycles have a warranty period of 5 years on the frame and the fixed fork (2 years on the suspension fork).
For electric bicycles, a warranty period of 1 years applies to the electronic parts, including lighting. No warranty applies with regard to wear-sensitive parts, such as tires, brake discs…
. The warranty period commences when the product is actually sold and an invoice is issued.
. The warranty lapses if a defect in the product is the result of an external cause and / or cannot be attributed to Squat deluxe Berlin GMBH. This includes, but is not limited to, defects as a result of corrosion, damage, incorrect or improper use, not properly and regularly maintained, making changes to the products, including improper repairs that have not been carried out with the permission of Squat deluxe Berlin GMBH.
. The warranty also lapses if the damage is caused by the buyer's negligence, for example because the buyer has acted contrary to instructions, directions or advice from Squat deluxe Berlin GMBH.
. Furthermore, there is no claim under warranty if the buyer has not fulfilled his (payment) obligations towards Squat deluxe Berlin GMBH.
. If research costs are incurred by Squat deluxe Berlin GMBH for the determination of a defect, on the basis of which warranty is excluded, these costs will be borne by the buyer. Squat deluxe Berlin GMBH strives to make this known in advance. The omission of this notification does not affect the buyer's obligation to pay these costs.
. In order to make his claim under warranty valid, the buyer must submit a complaint to Squat deluxe Berlin GMBH within 2 days of his discovery of the defect. If its complaint is found to be justified bySquat deluxe Berlin GMBH, Squat deluxe Berlin GMBH will, at its option, replace or repair the defective products, or parts thereof, free of charge.

8. Transport damage
   If goods are delivered with obvious transport damage, please report such errors to the deliverer as soon as possible and contact us immediately. Failure to lodge a complaint or to contact you has no consequences whatsoever for your legal claims and their enforcement, in particular your warranty rights. However, they help us to assert our own claims against the carrier or the transport insurance.

9 Right of withdrawal
A-Shop purchase: Returns are not possible in the store.
B-Internet Orders:You have the right to withdraw from the contract within 14 days without giving any reason. The cancellation period is 14 days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the last goods. To exercise your right of withdrawal you must contact us.
by means of a clear declaration (e.g. a letter sent by post, or email) of your decision to withdraw from this contract.
To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired.
Consequences of withdrawal
If you withdraw from this contract, we have to repay all payments that we have received from you, Excluding delivery costs. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will we charge you any fees for this repayment. The repayment will be made within 14 days from receiving back the goods.

The deadline is met if you send the goods before the period of 14 days has expired. the costs of the return must be borne by yourself. You will have to pay for any loss in value of the goods.
